At this point, you’re feelings most likely consist of two primary emotions. 1. You start to feel some sense of relief knowing that the process is almost over. 2. You may feel nervous about how the rest of the process, specifically probation, will progress.
We (http://the-florida-dui.com/) are here to help you take on the days following conviction with a sense of confidence. Concern yourself with your personal affairs, and let us gather all the pertinent information for you. Based on the reports of actual individuals who have successfully completed sentencing requirements, here is a guide for life after Conviction:

Typical Florida DUI Sentencing

1. Sentenced to 1 year Probation*

2. $ 250- $ 500 in fines

3. Ordered to a minimum of 50 hours of community service

4. DUI school

5. Wait period of 30 days for the hardship license application process. (For those who submitted to sobriety testing.)

6. Wait period of 90 days for the hardship license application process. (For those who refused sobriety testing.)

Possible additional sentencing may include:

1. Attending alcohol treatment sessions

2. Attending the “vehicle impact panel”

3. Paying restitution for any damages resulting from the DUI.

4. Apology letters to arresting officers, bearing any hostility on the night of your arrest

5. Requiring you to “abstain” from alcohol for the period of your probation

Probation
*The following probation information is designed with a typical first offense misdemeanor DUI in mind. Extreme circumstances involving death or serious injury will require the attention of legal professionals.

The probationary period required for all DUI convictions in the state of Florida is one year. This probationary period can actually be significantly shortened with the help of a lawyer. As soon as you complete all the terms of your sentencing listed above i.e. community service requirements etc; the remainder of your probationary period will consist of nothing more than meeting once a month with your probation officer to discuss any new arrests or charges that you may have incurred. In some counties, defendants only have to mail in a form once a month indicating whether or not they have any new arrests or charges. This process is known as “mail-in” probation. People have completed their sentencing requirements in as little as 3 months. Make sure to mention to your lawyer your desire to receive “early termination.” It will be their job to apply for early termination after 6 months of probation. In most counties, judges are usually very considerate of early termination. Probation officers are often overloaded with cases; therefore, releasing an individual, who has responsibly paid their debt to society, is generally not a problem. Your probation officer will typically be a nice person. Their job is to assist you in completing your sentencing requirements, i.e. community service requirements. This process can differ greatly by county, so it is imperative that you meet with a lawyer to discuss the details associated with your case and how DUI’s are handled in your particular county of arrest. It is important to note, that most people have no problems with probation. Do not be scared about this process. As long as you hold up your end of the bargain and do not violate the terms in your “Judgment and Sentence,” your probation will be a closing formality. Your probationary period should operate in a conflict-free and timely manner.

Attending the “vehicle impact panel”

This is simply an informational session educating individuals on the horrific tragedies associated with DUI Deaths. This can be a very touching experience, designed to compel people to never drink and drive again. The program lasts around 3-4 hours, so brace yourself for this time commitment. Upon completion, you will receive a certificate. Present the certificate to your probation officer so you can effectively cross off one more thing from your to-do-list!

Have you been ordered by the court to go to a DUI school? Do you resent it and think “What good can this school do? How can it help me?” Or are you going just to comply with the court order and to get it over with, get on with your life again? These questions and concerns that play in our mind are legitimate and must be addressed so that we can get the most benefit from a DUI class. Please consider the following:

1. DUI schools help us comply with the court order. That is the most basic. Compliance with the court order is crucial unless we want to be locked behind bars for defying a mandate by the court.

2. DUI classes will help first time offenders understand the effects of alcohol on the body. Most alcoholics do not realize how alcohol, once imbibed, even just a sip, can cause them to lose even their control in stopping from further drinking, resulting in high blood-alcohol content that spell trouble for the offender and the poor victims of drunk driving. The easiest way to get out of further trouble, they will tell you, is to stop immediately.

3. DUI schools give in-depth course for severe offenders that will help them reach complete abstinence from alcohol even just for the duration of the classes and hopefully assist them break their addiction. Students are expected to keep their commitments by being in their classes on time and to prepare to submit to random drug and alcohol screening. Some DUI schools ask repeat offenders to bring a family member to their sessions so that they too can provide the support for the recovering alcoholic.

4. DUI schools will provide us with the support that we need to overcome the addiction. Classmates can share experiences and support and school counselors can offer advice in a non-judgmental manner. The sharing of experiences will help us see that it is not only us who are struggling to break our habit. I know that no one wants to be an alcoholic. Everyone who has been caught in the web of alcoholism wants to get out of it because of the many problems with the community, our family, our work and even our self that is attendant with the addiction. Recovering alcoholics must avoid alcohol like the plague. Or else they will never free themselves from its deadly clutches.
